Contract entrapment usually happens because of what’s in the small print. A lawyer can help you before you sign a contract and then fail to comply with the clauses. A breach of contract can be liable, when one or both parties fail to comply with one or more clauses in the agreement. The failure to comply with any clause in the contract constitutes to a breach of contract. Both parties who have signed the contract might be in breach, in which case one can counter claim the other. In other words, claimant A takes claimant B to court because of a breach of contract. But claimant B responds with a counterclaim because they claim that plaintiff A is also in breach of contract.
We often talk about what’s in small print that can be overlooked. But the truth of the matter is that sometimes we are not clear on what’s in a clause.
