Your property boundary which divides yours and your neighbours space is called ‘Party Wall’. It’s basically where your territory ends and your neighbour’s territory begins. A Party Wall stands right between yours and your neighbour’s property. Party Walls can also be the division between multiple properties. It’s important to understand also that what the law says about party walls in England and Wales differs from Scotland.
Party Walls are usually seen in front and back gardens or yards. They may also be seen encircling a whole property. Some party walls are a part of the property structure but some are just a wooden fence. If the boundary is imposed by a wooden fence, even one inch of the fence could be crossing boundaries. If the boundary is part of the property building, there’s very little that can be contested, if anything at all.
If you are planning to carry out any building works in your property, you must notify your neighbour with plenty of notice. What does this have to do with ‘Party Wall’, you might ask. Regardless of the work you’re planning to carry out, if it affects your neighbours in any way, you should notify your neighbours. Do it out of courtesy, even if you don’t have to. But the law may require you to not only get planning permission, but also notify your neighbours in writing.
If you have any plans to do building works that affect yours and your neighbour’s boundary, you need to notify your neighbour in writing. If the work is on an existing party wall, or if you need to dig below, or near the foundation level of your neighbour’s property or party wall. Any works, repairs or adjustments to a boundary need to be properly notified.
