Imagine that one of the reasons that led you to buy a property is the beautiful fire place in the living room. But when you finally move in to your new home, one of the features that enticed you to buy the property is gone. Thankfully, it isn’t very common for sellers to rip out features that make the property so appealing.
Often, sellers will leave behind furniture and things that are not part of the bargain but the buyer is happy to inherit. Unfortunately, from time to time property solicitors are contacted by home buyers who need advice. The seller has taken away something that was meant to belong to the property and they buyer now needs someone to act on their behalf.
Furniture and fittings are part of the reason we choose to buy a property. If the buyer sells the property by using furniture and fittings as selling points, they can’t then walk away with the very reason why you bought the property in the first place.
You don’t buy property because of a fire place or garden furniture, but these are attractions that help a buyer make a decision. Buyers think about the area, whether there are good schools in the proximity, traffic, noise, the structure of the building, the architecture, the rooms in the house. Features make a home as much as decor and what the buyer brings in.
The seller must leave all the fixtures that are meant to belong to the property as well as those that are part of the sale of the property. For example, if the property is being sold with the dish washer, fridge, washing machine, then these must stay. Fireplaces and any fittings, such as carpets, must also stay.
