Remember A Charity In Your Will

You need to make special provisions, if you are planning to include your favourite charity in your will.  A will writing solicitor is legally qualified to ensure your will is drafted and executed according to your wishes.  This will guarantee that your property and any assets will be inherited by those you love and and by named charitable beneficiaries.  Just as you clearly identify those included in the inheritance, you must also clearly identify your charitable beneficiaries.

Clearly Identify Your Charity

Unless you’re absolutely clear about your charitable beneficiary’s exact name, you need to do some research.  Ensure that the correct name of the charity is clearly spelled.  You can check this with the Charity Commission.  You will also need to contact the charity and let them know of your intentions to include them in your will.  They can advise you and your solicitors accordingly.  Some charities will have a greater need in a particular branch.  They will likely ask you to make provisions so that any funds will go directly where the need is greater.

Contesting Your Will Against The Beneficiary

It is of vital importance that you are properly advised and well informed when naming your charitable beneficiary.  The costs to your estate could be great if you don’t make adequate provisions.  For instance, your heirs could make a claim against your estate under the provisions of the Inheritance (Provision for Family and Dependants) Act 1975.  Section 2 will support the right to apply for an Order if the will does not make reasonable financial provisions for your children’s maintenance.
