The Litigation Process – 5 Steps
Did you know that there are 5 main steps in civil litigation?
The first step is Investigation.
A civil litigation goes through an investigation stage, when your lawyer will be responsible for finding supporting evidence to help you win your case.
The second step is Pleading.
A Pleading is, in a nutshell, your side of the story. This will essentially include any damages and expenses incurred.
The third step is Discovery.
Sometimes law firms employ e-Discovery teams that specialise in gathering information, crucial evidence that will back up the case.
The fourth step is the stage of Pre-Trial.
This is the stage at which lawyers on both sides get together and enter negotiations in order to reach a Pre-Trial settlement.
The fifth step is the Trial.
If there’s no Pre-Trial settlement, then the case goes to Trial – the formal process for both sides to state their case. The judge and jury will then decide the settlement. SG
