If you’re looking to resolve a civil dispute, you need to contact a litigation solicitor. Litigation solicitors help individuals resolve civil disputes either by negotiation or by going to court. Generally, for commercial matters you can resolve the dispute in a private court, also referred to as dispute resolution.
Dispute Resolution
Resolving a dispute is done either in court or through arbitration or mediation. Arbitration takes place in a private court, while mediation is the process of negotiation between parties, overseen by an independent mediator. Solicitors will gather evidence and witnesses to support their client. Litigation solicitors are there to help you with your dispute.
Litigation Solicitor
A litigation solicitor can help you decide if your case should be settled in court or out of court. The other party’s litigation solicitor will discuss this with your solicitor as well and they’ll come to some arrangement with their clients approval. Your litigation solicitor will advise you on whether you have a valid claim, if you should settle it immediately or battle via arbitration or mediation.
Rules and Regulations
There are rules and regulations a solicitor must abide by. All solicitors are regulated by the SRA (Solicitors Regulation Authority), which means that if you are not happy with your solicitor’s conduct, you can make a complaint to an independent body who will investigate and act on your behalf.
The Litigation Work
The litigation case paper work is generally complex and time consuming. But it needs to be done and often a paralegal will assist the litigation solicitor in things like photocopying, putting relevant documents together in a file ready for court or for mediation.
