Noise Nuisance And Neighbours

Have noisy neighbours moved next door to you?

We all want to live in a detached house, preferably isolated from our neighbours, so that if we plan to throw a party, we won’t need to worry about disturbing our neighbours.  Equally, wouldn’t it be bliss if we lived so far apart from our neighbours that we couldn’t even hear their car engine, when they arrive home from work.

Unfortunately, many of us buy or rent property conscious that we’ll have to put up with standard noise from neighbours.  But imagine a worst case scenario: your quiet neighbour sold the flat and moved out.  In comes the new neighbour whose turned one of the bedrooms into a furniture workshop.  Your neighbour doesn’t care that the clock just struck 12 – midnight.  You’ve been trying to wind down since 10:30pm but your neighbour is still fiddling about with wood.  By 1am you’ve almost lost your sleep.

You’ve tried to reason with your neighbour but he’s got a business to protect.  What should you do?  Your new neighbour has affected your sleep patterns and has disturbed the peace.

Talking to your neighbour’s landlord, the housing association or the council are your first options.  Have other neighbours complained too?  Get them involved because your ‘Statutory Nuisance’ complaint will be backed up.  Remember that the council will not tolerate loud noises, dogs barking, loud music and industrial noises from machinery.

If you have enough grounds to take your neighbour to court, then start keeping a diary with dates, times and what activity took place that affected your peace. With a noise abatement order, you could take legal action against neighbours for unacceptable noise and anti-social behaviour.

If you are affected by these issues, please contact us for an informal discussion on the phone. SG
