Be Aware Of The Water

iStock_000015889102_SmallIt is hard to “jazz up” property law and make it interesting, however if you are thinking about “jazzing up” your garden with a swimming pool, hot tub or pond you may want to bear the following in mind:Planning permission does not need to be obtained if:

  • the property is not listed;
  • the pool/tub is within the boundaries of the property;
  • the property is not in an area of outstanding natural beauty.
Building regulation approval does not need to be sought where the pool or tub is outside and not covered by a structure i.e. an outhouse.  Where electricity is needed i.e. to heat up or light the feature, make sure you employ an electrician approved under the Part P Electrical Competent Person Scheme. That way you can be sure he has done the word in accordance with the regulations.Pools require consent from the water authority, who, if you do not already have one, will install a water meter in order to accurately bill you.  If you intend to create a pong then planning permission may need to be obtained. However this varies from council to council. Before starting the work consult your local authority to check what is required. Should you fail to obtain planning consent where it is needed you may face the risk of having to fill the pond back in at your own expense.
