Making a Will

All of a sudden everything goes silent as the realisation hits you, like a rugby ball to the chest, you are another year old! What if something happens to you tomorrow? A will is a document declaring how you wish to dispose of your property when you die. Increasingly we see cases where a will thought to be valid is contested successfully because it was not created in the correct manner. If a will is found to be invalid then the deceased’s property is distributed in accordance with the intestacy rules.  If you are married and your estate is no more than £125,000 then your spouse gets everything, however where your estate is more than £125,000 your spouse gets the first £100,000 and all your personal belongings. Your surviving blood relatives get the rest of your estate. Therefore if you want specific people to get specific things it is a good idea to make a will setting out your exact wishes.

It is important to note that if you create a will and then get married or enter into a civil partnership your will, will normally be revoked. Should you get divorced or your civil partnership be dissolved any reference made to your former spouse/partner will be ignored. In these circumstances it is also a good idea to get a solicitor to check whether your will is still enforceable.
